Summary: | The purpose of this thesis is to answer two questions regarding formal
provisions in the process of mediation at Department of Manpower and
Transmigration as provided in Statutory Law No. 2 Year 2004 regarding The
Settlement of Industrial Relation Dispute after the implementation of
Constitutional Court Verdict No. 012/PUU-1/2003, which are:
1. Does the Constitutional Court Verdict No. 012/PUU-1/2003, result an
amendment in the implementation of formal provision regarding mediation
at Department of Manpower and Transmigration?
2. How does the commencement of mediation proceed in respect of
registration for the dispute of employment termination based on severe
fault at Dinas Tenaga Kerja, and Sosial Kabupaten Sleman after the
implementation of the Constitusional Court Verdict No. 012/PUU-1/2003?
This thesis is an empirical thesis, however in order to support the thesis,
literature study is also added.
There were two locations at which were chosen as the locations for the
research. First is Dinas Tenaga Kerja dan Sosial Kabupaten Sleman. The
research took place at this location since in settlement of industrial relation
dispute, Dinas Tenaga Kerja dan Sosial Kabupaten Sleman is the authorized
agency representing the government for this type of dispute. On the other hand,
Arqom, Dony & Co were chosen since it is the authorized law office representing
PT. Hotel Juwara Warga as their legal consultant. In addition, this particular law
office also well known as the law office having a very high concern towards the
Settlement of Industrial Relation Dispute in DIY. |
