Summary: | A Collective Labour Agreement (CLA) is an important document for company
and an employee. Its aim is to ensure that the welfare of employees and their families
is maintained and improved. It is also to ensure a workplace in condusive to increasing
productivity. Collective Labour Agreement consists of works condition, rights and
obligation of both. In one company is only one Collective Labour Agreement.
Analysis juridical of three Collective Labour Agreement in PT �X�, the company
was signed three Collective Labour Agreement, it was Senakin Mine Project, Sangata
Mine and Satui Mine. Which is PT �X� have three Collective Labour Agreement and
one Company Regulation. This research will observes aplication of three Collective
Labour Agreement and Company Regullation in PT �X�.
The research method is the juridical empirical method, which is observes an
application of the Collective Labour Agreement and application of Company Regulation
in PT �X� comply with Act Number 13/2003 about Manpowership and
Kepmenakertrans Number 48/2004 and other related policy and regulation.
Upon the thesis writing, the Author used the approach of juridical empirical
method that is a method or procedure used to solve the obstacle, which starts in
advance with the examining of the secondary data and continues with examining of the primary data on the field. The obtained research result, Collective Labour Agreement in PT �X� is an illegal action. The negotiation didn�t comply with Manpowership act No. 13/2003, three Collective Labour Agreement causing differ guidance for schedule, roster, working hours and holiday doesn�t match each other. Company Regulation doesn�t better than Collective Labour Agreement guidance. |
