| Summary: | The proliferation of fake drugs, especially those contaminated with toxic chemicals, is becoming a huge threat to the health of the Filipinos and to the trade and manufacturing industry of the pharmaceutical sector directly affecting its industry credibility, undermining its business stability. By addressing this problem, this paper seeks to determine how the government can manage the spread of counterfeit drugs in the Philippine market. Various policies are provided with the hope that it will call on the attention of the legislature to conduct an inquiry, in aid of legislation, for amendments of existing laws or enactment of new laws. These will evaluate the possible legal remedies and will look at the best way to deal with the proliferation of fake drugs. In addition, it considers the conflict that arises when government agencies aim to reduce the harmful effects of the fake medicine trade while the pharmaceutical firms seek profit maximization. Thus, in order to protect the right of the people to good health, there is a need to re-assess the rules and regulations of the Bureau of Food and Drugs (BFAD) as well as their manner of enforcement of laws to develop policy options addressed to the legislative body of the Philippine government. |
